Finance Director Mickey Miller described the intent of the bill and answered questions from the committee.  The bill is intended to address 3 primary issues: 1) create a defined contribution retirement plan option; 2) allow portability of retirement savings for employees; and 3) give the City better recruitment ability.  For an employee who stays with the City for 25 or 30 years, the better retirement option will still be the traditional pension; however fewer and fewer employees are staying with the City for an entire career.  Shorter terms at multiple jobs is becoming more common in the working world and those employees will be better off under a defined contribution plan where they can carry their accumulated contributions with them to their next employment.  Mr. Miller indicated that new portfolio management products in the investment marketplace (life cycle and model portfolios) are producing better returns for defined contribution investors than used to be the case.  The defined contribution plan will be the default for new employees if the bill is approved, but they may opt to switch to the traditional defined benefit plan within the first year of employment , preferably after attending City-sponsored training classes to understand the options.

Andy Eckerd representing the Duval County School Board requested that the Council amend the stormwater utility to create a full exemption from stormwater fees for the public school system or, if not a full exemption, at least the option to take advantage of reductions and exemptions made available to 501(c)(3) charitable organizations.   In response to a question about the school system’s financial capacity and millage levy ability, Mr. Eckerd stated, and Chief Deputy General Counsel Cindy Laquidara confirmed, that the district is limited by a combination of state laws and case law to levying approximately 7.6 mills (less than the commonly assumed 10-mill property tax millage cap) without further action by the state legislature or a voter referendum.

Council President Davis proposed for an amendment to totally exempt charitable not-for-profit organizations and churches from the stormwater fee (increasing the available exemption from 50% to 100%) because of the value of the services that the non-profit community provides to the City and the relatively small loss of revenue ($300,000) that increasing the exemption would entail.

AMENDMENT – Council Member Hyde moved the Davis amendment, which failed for lack of a second.
